• Federal Court Of Appeal Extends Stay And Sets Date For Wind Mobile Hearing

  • March 1, 2011

Toronto, March 1, 2011 – The Federal Court of Appeal has set May 18, 2011 as the date it will hear the appeals brought by WIND Mobile and the Canadian Government following the Federal Court’s recent judgment that the Cabinet order regarding WIND Mobile’s ownership contained two “legal errors” and should be quashed. The Court of Appeal also granted a stay of that Federal Court judgment until it decides whether it should stand.

“From the beginning, we have maintained that we are fully compliant with the rules. Industry Canada saw this clearly. Cabinet saw this clearly. The Federal Court did not say otherwise, only that two “legal errors” were in the Cabinet order,” said Anthony Lacavera, Chairman of Globalive. “We are very confident the Court of Appeal will rule in our favour and look forward to putting these legal roadblocks set up by our competitors behind us.”

“In the meantime, we will continue to focus on our goal which is, and has always been, to offer Canadians real wireless choice, and to continue to take a leadership role in bringing real competition to the Canadian telecommunications market.”
